Lucky Draw

Launched by the Greater Bay Area Homeland Youth Community Foundation, this Lucky Draw aims to encourage young people in Hong Kong to capitalise on the development opportunities to pursue a new chapter of life in the GBA.

Lucky Draw Date & Result Announcement

Lucky Draw winners will be selected randomly by a specialist computer on 25 October 2022, and the result will be announced on both the Foundation and YO PLACE websites on 26 October 2022. The list of winners will be published in The Standard and Sing Tao Daily on 1 November 2022. Individual winners will be notified by email and phone according to the information provided on the registration form, within 5 working days of the day of the draw.

Terms and Conditions of the Lucky Draw

The "New Life in the GBA" Lucky Draw (the "Lucky Draw") is organised by the Greater Bay Area Homeland Youth Community Foundation Limited (the "Foundation"). By entering the Lucky Draw, participants are deemed to have agreed to these terms and conditions. The registration period for the Lucky Draw is from 27 April 2022 to 30 September 2022.


Eligible Participants:

(i) Any Hong Kong resident who has attained the age of 18 and is under the age of 46 on or before 30 September 2022; and

(ii) Holds a valid Mainland Travel Permit for Hong Kong and Macau Residents (the "Home Return Permit"); and

(iii) Has successfully registered as a YO PLACE member1 of the Foundation on or before 30 September 2022 and has a GBA Youth card2.


1. YO PLACE is an integrated online and offline youth platform developed by the Foundation. The platform supports Hong Kong youths with services and information on studies, careers and entrepreneurship opportunities in the Greater Bay Area (the "GBA"). Membership is free for registration: www.yoplace.org.hk

2. The GBA Youth Card is a comprehensive youth service card launched by the Foundation in collaboration with Bank of China (Hong Kong) ("BOC"), the Guangdong Youth Federation, Hong Kong United Youth Association and Macao Youth Federation. Application of the GBA Youth Card is subject to the applicable terms and conditions and the final approval of BOC. Registration for the Lucky Draw

(i) Eligible participants must register via the YO PLACE website ( www.yoplace.org.hk/en/luckydraw ) in order to enter the Lucky Draw.

(ii) Eligible participants must provide their full name in Chinese and English (as shown on their Hong Kong Identity Card), date of birth, Hong Kong Identity Card number (first 4 alphabets and digits), Home Return Permit number (first 4 alphabets and digits), GBA Youth Card number (last 8 digits), email address and Hong Kong mobile phone number in order to successfully register.

(iii) Registration opens at 9:00 a.m. on 27 April 2022 and closes at 11:59 p.m. on 30 September 2022 (Hong Kong time) (the "Registration Period").

(iv) Upon successful registration, each eligible participant will receive a registration confirmation email generated by the system.

(v) Eligible participants are entitled to only one Lucky Draw entry. Duplicate registrations will be disqualified. Only the personal information of the first registration will be used for verification. No eligible participant may win more than one prize.


Prizes

(i) Subject to eligibility, the Lucky Draw winners will be selected randomly on 25 October 2022 by a specialist computer system.

(ii) Costs of the Grand Prize including price of the residential apartment, all Mainland China solicitors' fees, deed tax and property maintenance funds required for purchasing the apartment, will be solely and fully borne by the sponsor – Ng Teng Fong Charitable Foundation Limited (the "Sponsor") of the Lucky Draw.

(iii) An independent auditing firm, PwC HK, will perform procedural checks on the key processes and system controls relating to the Lucky Draw. The draw will be witnessed by Mr Chan Hiu Fung, Nicholas MH JP, the legal adviser of the Foundation.


Announcements of the Result

(i) The winners will be announced on both the Foundation ( www.gbayouth.org.hk ) and YO PLACE ( www.yoplace.org.hk ) websites on 26 October 2022 and will be published in The Standard and Sing Tao Daily on 1 November 2022. Each Eligible Participant agrees that in case of winning any of the Grand Prize, Second Prize and Third Prize, the Foundation can announce and publish the first 4 alphabets and digits of his/her Hong Kong Identity Card and the last 4 digits of his/her mobile phone number as provided upon registration when announcing the results of the Lucky Draw.

(ii) Individual winners will be notified by email and phone via the email address and mobile phone number provided on the registration form, within 5 working days of the day of the draw.


Prize Redemption

(i) The Grand Prize winner is required to redeem the prize in person according to the instructions provided by the Foundation at the Foundation office (16/F, 9 Des Voeux Road West, Sheung Wan, Hong Kong) on or before 4 November 2022 during office hours (Monday to Friday, 09:00-18:00, except public holidays). The winner is required to prove his/her eligibility to the Foundation by presenting his/her original Hong Kong Identity Card, Home Return Permit, valid GBA Youth Card and YO PLACE membership. If the Grand Prize winner fails to redeem the prize on or before 4 November 2022, and/or fails to prove his/her eligibility and/or present the required documents, the Foundation reserves the right to disqualify him/her. The Grand Prize will be transferred to the Grand Prize winner on an "as-is" condition, with the fittings, finishes and appliances as described in the sales brochure for Empyreal-Bay issued by the developer.

(ii) For the Second Prize, Third Prize and Participation Prize winners, the prizes will be credited to the winner’s GBA Youth Card as spending credit on or before 23 December 2022 without prior notice. The GBA living expenses spending credit and transportation allowance can only be used for retail purchases and cannot be used for cash advances. Winners must keep their GBA Youth Card account and YO PLACE membership valid when receiving the spending credit. If the winner’s GBA Youth Card account and YO PLACE membership are terminated for any reason or does not remain valid, he or she will be disqualified, without prior notice.

(iii) No winner is entitled to any alternative gift or payment of cash in substitution of his/her prize. Winners are not allowed to transfer their eligibility to receive prizes.

(iv) Information provided by the participants on the Lucky Draw website cannot be changed after registration. Any duplicate, faulty or incomplete information will be deemed invalid. If participants cannot be notified about collecting the prize due to any false, incomplete or incorrect information provided, the Foundation will not be held liable and/or provide any compensation.


Personal Data

(i) Data collected from eligible participants during the Registration Period will be used only for purposes relating to the Lucky Draw. Participants who have not provided all the required information will not be eligible to participate in the Lucky Draw.

(ii) Each winner is deemed to have agreed to the Foundation's disclosure of the winner’s name, Hong Kong Identity Card number, GBA Youth Card number and the prizes to BOC for verifying his/her GBA Youth Card account status and arrangement for crediting the spending credit.

(iii) Information (including personal data) collected during the Lucky Draw may be disclosed and transferred to the data processor or other agents of the Foundation engaged in conducting or monitoring the Lucky Draw on a need-to-know basis only. This information will be properly stored and encrypted and will be destroyed 45 days after the end of the Lucky Draw (the date on which all prizes are distributed).

(iv) Any person who has provided his/her personal data to the Foundation in relation to the Lucky Draw has the right to request access to his/her personal data held by the Foundation. Please write via email to info@yoplace.org.hk or by standard mail to 16/F, 9 Des Voeux Road West, Sheung Wan, Hong Kong, in care of the Office Manager of the Foundation.

(v) Participants should read the "Data privacy policy" and "Disclaimer" on the YO PLACE website ( www.yoplace.org.hk ).


General

(i) All staff and council committee members of the Foundation and related staff of the external service providers who are involved in the development of the Lucky Draw system and auditing of the Lucky Draw are not eligible to participate in the Lucky Draw.

(ii) If the Grand Prize winner fails to redeem the prize in person on or before 4 November 2022, or prove his/her eligibility or present the required documents, the Foundation reserves the right to disqualify him/her, and the prize will be awarded to another winner according to the sequential order of the second prize winner list selected randomly by a specialist computer system on 25 October 2022.

(iii) According to the regulations of Mainland China, Hong Kong residents can only purchase /own one residential property for self-use and/or self-occupancy. As such, the Grand Prize winner should not have currently owned any residential property in the Mainland China to qualify for receiving the Grand Prize, otherwise his/her eligibility will be disqualified and the Grand Prize will be awarded to another winner according to the sequential order of the second prize winner list selected randomly by a specialist computer system on 25 October 2022.

(iv) For the avoidance of doubt, if the Grand Prize winner is, for any reason, not eligible to own a residential property in Zhongshan under the laws of the People’s Republic of China, his/her eligibility will be disqualified and the Grand Prize will be awarded to another winner according to the sequential order of the second prize winner list selected randomly by a specialist computer system on 25 October 2022.

(v) If the Second Prize and Third Prize winner’s GBA Youth Card account and YO PLACE membership are terminated for any reason or does not remain valid, Foundation reserves the right to disqualify him/her and award the prize to another winner according to the sequential order of the winner list selected randomly by a specialist computer on 25 October 2022. Same logic applies to the rest of the prizes won by winners who are disqualified.

(vi) The Foundation has the right to request that each winner prove his/her eligibility by presenting the required documents, including his/her original Hong Kong Identity Card, Home Return Permit, valid GBA Youth Card and YO PLACE membership. If winners fail to prove their eligibility or present the required documents, the Foundation reserves the right to disqualify them and award the prize to another winner according to the sequential order of the winner list selected randomly by a specialist computer on 25 October 2022. Same logic applies to the rest of the prizes won by winners who are disqualified.

(vii) The Foundation is not a supplier of the products or services relating to the prizes of the Lucky Draw and shall not be held responsible for any matters relating to the quality or services relating to the prizes of the Lucky Draw. Any enquiry in relation to the quality or services relating to the prizes shall be directed to the relevant supplier. To the maximum extent permitted by law, the Foundation accepts no liability for any (including but not limited to direct or indirect) loss, damage or personal injury (excluding liability for any death or personal injury caused by the Foundation’s negligence) of the prize winners resulting from the use of the products or services relating to the prizes.

(viii) BOC Credit Card (International) Limited ("the Card Company") or Bank of China (Hong Kong) Limited ("BOC") are not organisers of the Lucky Draw. For any enquires about the Lucky Draw, please contact the Foundation. BOC and/or the Card Company are not suppliers of the products or services relating to the prizes of the Lucky Draw and shall not be held responsible for any matters relating to the quality or services relating to the prizes of the Lucky Draw. Any enquiry in relation to the quality or services relating to the prizes shall be directed to the relevant supplier. To the maximum extent permitted by law, BOC and/or the Card Company accept no liability for any (including but not limited to direct or indirect) loss, damage or personal injury of the prize winners resulting from the use of the products or services relating to the prizes.

(ix) The Foundation has the sole and absolute discretion in determining a person’s eligibility to enter the Lucky Draw and/or receive any prize, according to the relevant clauses in these Terms and Conditions.

(x) No person other than the eligible participants and the Foundation will have any right under the Contracts (Rights of Third Parties) Ordinance to enforce or enjoy the benefit of any of the provisions of these terms and conditions.

(xi) If any dispute arises from or in connection with the Lucky Draw, the decision of the Foundation shall be final and conclusive.

(xii) If there is any discrepancy in the information contained in the promotional materials, these terms and conditions shall prevail.

(xiii) The Lucky Draw is held in Hong Kong. These terms and conditions shall be governed by and construed in accordance with the laws of Hong Kong, and each eligible participant will submit to the exclusive jurisdiction of the courts of Hong Kong.

(xiv) In case of any discrepancy or inconsistency between the Chinese and English versions of these terms and conditions, the Chinese version shall prevail.

1. Who is organising and sponsoring this Lucky Draw?

The Lucky Draw is organised by the Greater Bay Area Homeland Youth Community Foundation Limited (the "Foundation"). The Grand prize is sponsored by the Ng Teng Fong Charitable Foundation Limited; other prizes are sponsored by the Foundation.

2. Who is eligible to participate in the Lucky Draw?

The Lucky Draw is open to any individual who

(i) is a Hong Kong resident who has attained the age of 18 and is under the age of 46, on or before 30 September 2022;

(ii) holds a valid Mainland Travel Permit for Hong Kong and Macau Residents (the "Home Return Permit"); and

(iii) has successfully registered as a YO PLACE member of the Foundation on or before 30 September 2022 and has a GBA Youth Card

3. I am not a permanent Hong Kong resident, but I am a Hong Kong Identity Card holder – can I still register?

Yes. Non-permanent residents of Hong Kong holding a valid Hong Kong Identity Card are eligible to participate in the Lucky Draw. You must, however, meet the other requirements stated in FAQ2.

4. What is YO PLACE?

YO PLACE is an integrated online and offline youth platform developed by the Foundation. 6. Why do I need the GBA Youth Card to participate in the Lucky Draw?

The GBA Youth Card is the channel for distributing prizes to the winners. Winners will have their prizes (excluding the Grand Prize) credited to the GBA Youth Card.

7. What are the prizes in the Lucky Draw?

a) Grand Prize – a decorated 3+1 bedroom residential apartment at Empyreal-Bay, No. 13 Caiqing Road, West District, Zhongshan, GBA (with a Gross Floor Area of 105 square metres and a value of approximately HKD$2,500,000, sponsored by the Ng Teng Fong Charitable Foundation Limited. The Grand Prize winner should not have currently owned any residential property in the Mainland China to qualify for receiving the Grand Prize.).

b) Second Prize – GBA living expenses spending credit of HK$20,000 (20 winners).

c) Third Prize – GBA living expenses spending credit of HK$1,000 (500 winners).

d) Participation Prize – GBA transportation allowance of HK$100 for all eligible participants (Winners of Grand Prize, Second Prize and Third Prize are not included).

8. Who pays the various fees involved (e.g. stamp duty) for the winner to receive the Grand Prize?

Costs of the Grand Prize including price of the residential apartment, all Mainland China solicitors' fees, deed tax and property maintenance funds required for purchasing the apartment, will be solely and fully borne by the sponsor – Ng Teng Fong Charitable Foundation Limited.

9. How do I know when the prizes will be drawn (i.e. Lucky Draw results)?

15. Will my data be kept confidential?

All data collected during registration will be used only for purposes relating to the Lucky Draw. Your information will be properly stored and encrypted, and will be destroyed 45 days after the Lucky Draw ends (the date on which all prizes are distributed). 16. Can I win more than one prize?

No. Each eligible participant will win only one prize.

18. Can the winners nominate anyone else to receive their prizes?

No. The Grand Prize winner is not allowed to nominate any other person to receive the prize.

19. Am I eligible to participate in the Lucky Draw if I am an employee of the Foundation?

No. All employees and Council Committee members of the Foundation and related staff of the external service providers who are involved in the development of the Lucky Draw system and auditing of the Lucky Draw are not eligible to participate in the Lucky Draw.

20. Will the Lucky Draw be transparent, open and fair?
